The horse is sold "as is, where is", with no warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. The Buyer has had the opportunity to inspect it and accepts it in its present condition.

The Seller states that they are the lawful owner, that the horse is free of all liens, loans and encumbrances, and that they have the right to sell it.

What a horse bill of sale should include

  • Registered and barn names, breed, sex, age, color and markings
  • Registration number, and who handles the registry transfer
  • Date of the last negative Coggins test (required for most interstate travel)
  • Whether a pre-purchase vet exam was offered
  • An as-is statement about soundness and temperament

After you both sign

  1. Make two copies. Each side keeps a signed original or copy.
  2. Seller: keep your copy with your records for at least three years.
  3. Buyer: keep the bill of sale as your proof of ownership.

Questions people ask

Does a horse bill of sale transfer the papers?

No. Registries such as AQHA or The Jockey Club have their own transfer forms signed by the recorded owner. Say in the bill of sale who will send it and by when.

What is a Coggins test?

A blood test for equine infectious anemia. Most states require a recent negative result to move a horse across state lines, so buyers usually ask for it at sale.
